1. Agreement to Terms

By accessing or using MerchMuse ("Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Description of Service

MerchMuse is an AI-powered tool that generates product listings for print-on-demand platforms. The Service analyzes design images and creates titles, bullet points, and descriptions optimized for marketplace guidelines.

3. User Accounts

To use the Service, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

4. Credits and Billing

  • Credits are the currency used to generate listings within the Service.
  • A full listing generation costs 3 credits. Individual field regeneration costs 1 credit.
  • Subscription credits reset each billing cycle. Purchased credit packs never expire.
  • Subscription credits are used before purchased credits (FIFO).
  • Subscriptions renew automatically unless cancelled before the renewal date.

5. Acceptable Use

You agree not to:

  • Upload content that infringes on intellectual property rights
  • Use the Service to generate misleading or fraudulent listings
  • Attempt to circumvent usage limits or security measures
  • Share account credentials with third parties
  • Use automated systems to access the Service without permission

6. Content Ownership

You retain ownership of designs you upload. Generated listings are created for your use in accordance with your subscription. MerchMuse does not claim ownership of your content.

7. Compliance Checking

The Service includes compliance checking features that scan for policy-related content, formatting, and character-limit issues. This checking is provided as an assistive tool; it does not perform trademark database searches, legal review, or guarantee compliance with any marketplace's policies. You remain solely responsible for ensuring your listings comply with all applicable rules and regulations.

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT GUARANTEE THAT GENERATED LISTINGS WILL BE ACCEPTED BY ANY MARKETPLACE OR THAT THEY WILL RESULT IN SALES.

9. Limitation of Liability

MerchMuse shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the Service.

10. Refunds

Refunds are available within 7 days of purchase only if no credits have been used after that purchase or billing period start. Once credits are used, purchases are non-refundable. Contact support@merchmuse.art for refund requests.

11. Termination

We reserve the right to suspend or terminate your account for violations of these terms. You may cancel your subscription at any time from your account dashboard.

12. Changes to Terms

We may update these terms from time to time. Continued use of the Service after changes constitutes acceptance of the new terms.
